By creating an account on www.chronoflotimeline.com (the Service),
you (the User) agree to the following terms and conditions:
1.1 You may only set up one free standard account.
1.2 Accounts created on wwww.chronoflotimeline.com must only be used by the individual or company that set-up the account. It is strictly forbidden - unless permission has been given by the owners of ChronoFlo Timeline - for an individual or company to sell or rent timelines created on ChronoFlo Timeline to another individual or company. Nor can an individual or company employ another individual (unless the individual is a direct employee of the company that owns the account with ChronoFlo Timeline) or company to create a timeline for them, unless permission has been given by ChronoFlo Timeline. It is also forbidden for companies/consultants to purchase or operate ChronoFlo Timeline accounts on behalf of their clients, without written permission from ChronoFlo's owner. Digital agencies/consultants wanting to use ChronoFlo for client projects should contact us at help@chronoflotimeline.com
1.3 Timelines are only embeddable with active Bronze or Silver accounts. If an account is downgraded because monthly or annual payments are stopped, the account's timelines will no longer appear on external websites.
1.4 You must be at least 13 years old in order to create an account on www.chronoflotimeline.com or have obtained parental consent to create an account. Parental consent can only be obtained by going through the process outlined here.
1.5 You agree that ChronoFlo Timeline can use the data you provide us as outlined in our privacy policy. We aim to collect the minimum personal information necessary to ensure our service functions properly and for us to meet our legal, accountancy and customer service obligations. 1.6 You must own the intellectual property (copyright and trademarks) or have permission from the copyright/trademark holders for any images, videos or other content you include in a ChronoFlo Timeline timeline.
1.7 You agree that the Service contains copyrighted material, trade secrets, and other proprietary intellectual property that are property of Webalon, the operator of ChronoFloTimeline.com. Webalon and ChronoFlo Timeline are protected by copyright, trade secret, and other proprietary rights and laws, and this content can only be used or accessed as specifically provided for in these terms of service.
1.8 You may not store any of ChronoFloTimeline.com (including any portion of the software or documentation) on any computer or other device, or copy or otherwise use such information to create derivative works.
1.9 You are responsible for maintaining the security of your account and password. We will not be liable for loss or damage due to failure to comply with this obligation.
1.10 The services offered through this site are provided as-is and without warranty. We may discontinue the service or cancel accounts at any time with or without reason.
1.11 Though we do everything possible to maintain a reliable service, ChronoFlo Timeline cannot guarantee that the Service will be error free or uninterrupted, and cannot be responsible data loss. Under no circumstances will ChronoFloTimeline.com and its owner Webalon bear any responsibility for any damages arising as a consequence of such unavailability.
1.12 To the extent authorized by law, you agree to defend, indemnify, save and hold ChronoFlo Timeline harmless from any and all demands, liabilities, losses, potential losses, claims, costs and expenses (including attorney's fees), asserted against ChronoFloTimeline.com, its affiliates, subsidiaries, partners, agents, customers, officers, contractors, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by you.
2.1 The Bronze account is only available to individuals and small community groups. For business use, the Silver or above accounts must be used. Those who break this condition will have their accounts deleted without warning.
2.2 When you stop paying for a Bronze or Silver account, you agree that your account will be downgraded to the free level, which offers a single un-embeddable timeline and that any extra timelines you may have created will not be editable or viewable, until you re-upgrade your account. Your timeline may also be restricted to the 50 event limit available with the free account. We retain the right to completely delete all free account timelines in future.
3.1 ChronoFloTimeline.com does not allow any of the following content, or links to external sites containing such content, on timelines created by users:
(i) Pornographic or sexually explicit material
(ii) Content of an illegal nature, including copyright materials
(iii) Content that is deemed to be threatening, obscene or that has the purpose of inciting hate
3.2 You may not decompile, disassemble, reverse engineer, copy, create a derivative work, or display the ChronoFlo Timeline Software code in human readable form, or otherwise use ChronoFloTimeline.com (which includes its software and documentation) except as explicitly provided for in this agreement.
3.3 You agree that you will not store, copy, modify, rent, lease, loan, sell, distribute, transfer, transmit, display, reverse engineer, reverse assemble, or otherwise attempt to discover any programming code or any source code used in or with the Services. You may not sell, assign, sublicense, grant a security interest in or otherwise attempt to transfer any right in the Services (which includes its software and documentation), create derivative works based on or in any manner commercially exploit the Services, in whole or in part.
3.4 You agree to only use the timeline JSON and CSV options to manually back up your timelines, convert a timeline for use with our desktop app, or to populate a timeline created using our Single Timeline License product.
3.5 The JSON and CSV options are strictly not available as web feeds to be called from your servers or website, without prior permission from ChronoFlo Timeline. You agree that if you use the JSON and CSV options for such a purpose without our permission, your account may be closed without warning.
3.6 You agree not to use any automated process to scrape our website for data. You agree that if you use our service for such a purpose, your account may be closed without warning.
3.7 Users of our JSON/RSS/iCal feed functionality agree that the feed cannot be used to make a timeline generate different content on the basis of a user's identity, search term or any other basis, without permission from Webalon Ltd. Use of cookies or other methods to generate different timeline content based on user's id, search term or any other criteria is strictly forbidden and will result in an account being closed without warning.
4.1 All premium accounts are billed in advance. Monthly plans rebill every 30 days. We cannot provide refunds or cash credits for account downgrades or cancellations.
4.2 Cancellation of a premium account must be submitted seven business days prior to the rebilling date.
4.3 All premium accounts are billed in advance, and are non-refundable.
4.4 Timelines may be deleted following account cancellation.
5.1 If for any reason any provision of these terms of service shall conflict with any statute, law, regulation or ordinance, then in such event the provision in question shall be modified only to the extent necessary to bring it within such requirements, and (as modified) these terms of service shall continue in full force and effect.
5.2 We reserve the right to modify these terms and conditions at any time and for any reason, with or without explicit notification to you. Continued use of the Site after any such changes shall constitute your consent to such changes. It is the user's responsibility to check these Terms and Conditions from time to time.
